Advice for Angel as to where and how she can start an action in the civil courts, and how the case is likely to proceed to, and including, the hearing.
Before Angel takes legal action, she must try to settle the case by alternative dispute resolution because a formal court trial can be very expensive and time wasting for the court. This involves Angel making an agreement over how much money she should receive from the defendant, Diablo, with Diablo himself.
If Angel and Diablo do not agree, or Diablo refuses to communicate with Angel, Angel must then take legal action by filling out a claim form, which is obtained at the county court. Help and advice on filling out the form is available from the Citizens Advice Bureau.
After filling out the form, it must be handed to the county court, not the defendant. The county court will then send a copy of the claim form and a response pack to the defendant, Diablo. He will then do one of three things; admit that the claim is owed, defend the claim, or do nothing, which could result in Diablo having to pay the full amount you requested.
