Scene One

(This scene takes place in court)

30th November 2006

Court Rep:         The court shall rise to welcome the honorable judge miss Melody.

Judge:        You all may sit.

(a moment of silence)

Counsel you may state the case.

Court Rep:        A case of rape: under section 296 of the Cameroon penal code.

Judge:        What does the accused plead?

Accused:         Not guilty.

Court Rep:        The accused shall lay his pledge.

Pastor:         Are you a Christian, Muslim or pagan?

Accused:         Muslim.

Pastor:         Do swear before this Koran that whatsoever you say will be the truth, the whole truth and nothing but the truth?

Accused:        I, Mr. Amadou, do state before this Koran that whatsoever I will say will be the truth, the whole truth and nothing but the truth.

Judge:        Prosecution Counsel, you may raise your case.

P.C.:        Now Mr. Amadou, could you please tell this court where exactly you were on that fateful night of the 25th November 2006?

Accused:        With all due respect your honour, I am a Muslim. I believe in the doctrine of the Koran. So I don’t see why you should intrude into my privacy by asking where I was.

P.C.:        Listen Mr. Amadou, you are in court remember? You’ve just said no-one should intrude into your privacy. I doubt if you have one. You also said you believe in the doctrine of the Koran. Does that doctrine state that rape is legal?

Def. C.:        Objection my Lady, counsel is making senseless assumptions, thereby wasting the time of this honourable court.

Judge:        Objection overruled. Prosecutor, go straight to the point.

P.C.:        As your Ladyship pleases. Now Mr. Amadou, I would be asking you this question for the very second time; where exactly were you on that fateful night?

Accused:        I was in Yaounde carrying out business on the request of the governor.

P.C.:        Oh! You were in Yaounde carrying out business for the governor? Could you please mention the type of business precisely?

Accused:        Your honour, I was carrying out contracts.

P.C.:        Mr. Amadou, you were carrying out contracts which are bloody? Such contracts include rape? Do not deny it.

Def. C.:        Objection my Lady, our English law states that a man is innocent until proven guilty by the court of law.

Judge:        Counsel is right. Prosecutor, are you aware of the fact that there are legal proceedings in this court?

P.C.:        Oh yes. I am very aware my Lady and I would like the defense counsel to go through his scripts again. Then he would see that our French law also states that a man is always guilty until he is proven innocent by the court of law. And my Lady, I would like this court to be aware of the fact that I’ve got pictures as evidence to prove that this criminal is a shameless rapist and I would like these to be tendered as an exhibit.

Judge:        So be it. Tender this as exhibit 205. Any further comments please defense counsel?

Def.C.:        My Lady, if you don’t mind, I would like to see the pictures.

        (The pictures are given to the defense counsel to see.)

Def.C.:        My Lady, Abraham Lincoln once said, “You can fool some people all the time. You can fool all the people some of the time. But you can not fool all of the people all the time.” My Lady, if you look closely at the pictures, you would see that my client’s face isn’t visible and that the face of the victim is covered. So, we neither know who the victim is, nor who the rapist is. So my Lady, I would therefore ask this court to agree with me that there is no clear proof or evidence that my honourable client, Mr. Amadou, committed the crime.

Judge        Prosecution counsel it seems your evidence is not substancial enough I will

                   give you more time to prepare your witnesses this case is adjoined to the 7th
