Outline the theory of the separation of powers, illustrating your answer with examples.

To avoid having a dictator the state is split into three different branches Executive, Legislative and Judiciary. Her majesty the Queen controls each of the sectors of the government. It was Montesquieu who came up with the theory to have 3 different functions of state. He believed that for a state to be 'successful' it needed three functions which were kept separate at all times. The Lord Chancellor (L.C) held roles in each of the three different branches. In the executive, he is a member of the cabinet and is involved with appointing new judges and other court employees connected with legal aid. When it comes to legislative, the L.C was a speaker in the House of Lords and was involved with introducing new bills. Lastly, for the Judiciary branch, he may sit as one of the judges in the House of Lords or also he may be the nominal head of the chancery division.

Executive is the government part of the divide and is responsible for the day-to-day run of the state. Members of the executive branch are chosen specifically by the Queen, the leader of the executive party in England is Tony Blair. One of the roles of the executive branch is to put the laws, which the Legislative branch makes up into effect. Another function of the executives is to make sure that the country is safe and to maintain a police force and armed forces. The collection of taxes and custom duties to pay the government employees is another function. They are also responsible for regulating many areas of the economy sectors e.g. transportation, housing and construction.

Legislative, is the branch of the state, which has the power to adopt new laws for the country. The legislature is known mostly by either Parliament or Congress. The legislature is supreme and appoints members of the executive. In addition to enacting laws, the legislature also has the power to raise taxes and adopt the budgets and other money bills. Legislative are also the speakers of the House of Lords in its legislative function.
