Tort Law

INTRODUCTION The core purpose of this assignment will be to analyse how the neighbourhood principle which is related to pure economic losses is interpreted by the courts. In order to simplify and understand the decision the courts to made regarding negligence involving pure economic loss; we are first required to understanding what negligence means. The torts of negligence have specific elements which are the complex concept of legal duty of care, breach, causation and damage thereby suffered to the person whom the duty owed. 1 I shall give a short definition of pure economic losses relevant in tort law and what is implied in the neighbourhood principle interface in tort law. The definition for pure economic loss can be articulated as economic loss which is unaccompanied by physical injury or damage. It is also commonly known that pure economic loss is an umbrella term used to bring together various different policies regarding compensation, damages, lost income and loss.2 We therefore must discover the connections and differences between recovering damages or compensation in regard to pure economic loss in the neighbourhood principle. In the neighbourhood principle, to ask the question of whether C owes D a duty of care. The courts then hold the defendant liable to whether C ought to take care to look after D's interest.3 In the neighbourhood principle, the

Which had the greater effect on the course of the war, the withdrawal of Russia or the entry of the USA?

Which had the greater effect on the course of the war, the withdrawal of Russia or the entry of the USA? On the 11th of November 1918 at 11o'clock the armistice to cease war was signed at Versailles. But what brought around the agreement to end the war, what caused it? In years since, historians argue two main points amongst other small issues of how the Great War ended. The Great War as it was named was the war to end all wars, in hindsight we now see that there was a Second World War and thus the Great War becomes the First World War. The main points which historians are split over are; was it the USA's entry or the withdrawal of the USSR that brought around the end of the war? There are other issues that historians and the general public discuss and argue over, the British blockade and the tank are two of those. I will be discussing and evaluating these factors. In April 1917 the USA entered the war, after a length of time officially staying out of the war. The USA had not been involved in the war that they called senseless and was none of their own making. The Americans didn't see why American husbands and sons should die in a war that was petty squabbling. However the Americans favoured the allies and sold war ammunition and contributed to the allies in ways other than fighting. Although America was not in the war it joined on the 6th April 1917. Looking back with

Why did a minority Tory government end up passing a far more reaching measure of parliamentary reform in1867, than its minority liberal predecessor in 1866? After the death of the Liberal leader Palmerston in 1865, Lord John Russell replaces him as P.M. Palmerston was opposed to any types of reform and wanted to maintain the old parliamentary system, but Russell however was enthusiastic in the on the notion of parliamentary reform, he wanted the franchise extended to "respectable" literate god fearing men. However even prior to Pam's death, there were indications that the Liberal Party were edging towards reform like for example the work of John Bright a Birmingham MP who had achieved a bonds between the working and middle classes that hadn't been achieved anywhere else - this further showed that working classes could be respectable and deserving of the vote. In 1866 Gladstone proposed his Reform Bill, not very radical terms - increase franchise 200,000 in boroughs and 170,000 in the counties - redistribution of seats proposed calculated to give more of an advantage to the Liberals, however the bill did have weakness which meant it excluded the poorest householders i.e those whose property had a an annual rate of £6 or less. The Liberal Reform Bill was published in 1866 and proposed lowering the franchise to £7 in boroughs and £14 in the counties, with votes also

christian vocation coursework

(a)(i) Describe how a Christian may follow the call to discipleship through daily life and work Vocation is the idea that people get a call from god to do a certain job this can also be said about being called into Christianity by god, it may not be an actual call or a big flash of light but just s feeling that you have created by god. 'Vocation' comes from the Latin word meaning 'to be called'. Some Christians may say that they were called to Christianity and so were all Christians. For example Jesus was called by god, he heard his voice when he was baptised by John. Discipleship is another term used my Christians used to mean following Jesus like his disciples did, living a Christian lifestyle and helping others also apply to discipleship. Christians follow Jesus by following his examples like his love, service and compassion towards others. Someone who has chosen to follow Jesus should be living a caring helpful life, possibly in a caring profession such as a doctor, nurse or teacher. Any job can be a vocation, some Christians say god has a plan for everyone and he may call you to a job that isn't related to Christianity at all. St. Paul said in Colossians 3:23 "whatever you do, work at it with all your heart, as working for the lord, not for men." Possibly meaning that god has called everyone to their jobs because he knows its right for them so work for him and do the

One of the main issue here is whether Adder is liable for Bust Ltd going into liquidation, and whether Adder is liable for Kevin, Pablo's financial loss, including physical injury to Pablo, this also includes whether Adder is also liable for Musko Plc's loss of profit for Pablo not performing at there theatre. Let start of with Adders liability for Bust limited, where he mislead the company's financial report in negligent, leaving the company in liquidation. The Hedley Byrne case introduced the concept that a claimant could recover for economic loss; however the courts have always distinguished such an action for pure economic loss, arising out of negligence act. The House of Lords held that no duty of care was accepted by Heller and none arose, so the claim failed, the Lordship stated obiter that in appropriate circumstances, there could be a duty of care to give careful advice, and that breach of that duty could give rise to liability for negligence, but the fact is the sole damage was economic loss did not, they said did not effect the question of liability, this proves that Adder may not be liable for Busted Ltd. If we look at the legal principle laid out in Spartan Steel v Martin Co Ltd, the defendants negligently caused all three of the types of loss that resulted from the power cut and all three types of loss were easily foreseeable, the court only compensated for

Evaluate the Iago/Othello dynamic in Act III scene iii - Why is it so easy for Iago to convince Othello that Desdemona is committing adultery?

Evaluate the Iago/Othello dynamic in Act III scene iii. Why is it so easy for Iago to convince Othello that Desdemona is committing adultery? It's very interesting to note the structure of Act III scene iii. At first we see Desdemona and Othello on stage; she is playful and exceptionally admit that Cassio be reinstated as Lieutenant. It's fair to say that Othello is not in his right state of mind, even before Iago enters; it feels as though Othello is already in the grip of emotions he cannot handle. He seems uneasy during his conversation with his wife; there is a hint of resignation in his line "I will deny thee nothing." Following this we see Iago beginning his manipulation, he is extremely tactful in the way he presents his poisoned allegations, purposely keeping Othello hanging; playing with his words. "Honest, my lord?" "Think, my lord?" Desdemona re-enters and we can see that Iago's word have begun to eat away at Othello, his poor judgment shows his inability to think for himself. Desdemona, who is trying to shear her honest thoughts with him, is sent away, although, he is impatient to hear Iago's (false and evil) thoughts. The structure of this scene illustrates how powerful Iago's character is, each time Desdemona re-enters, we see Othello becoming more and more infected by Iago's poison. Othello is actually carrying out Iago's revenge for him by asking the

I. INTRODUCTION Human rights development impacts on the relationship between the form of life of the jurist and the office of the jurist in a number of ways. Thus it is integral that we analyse and critique the relations between the form of life and the jurisprudence of the office in the domain of the human rights. The essay will attempt to look at this relationship within the lens of natural law jurisprudence. And whilst we could simply look at how these links are affecting the jurist it also important to look at how we can proceed within the arena of human rights development and how the relationship may change. Jurisprudence theorist such as Finnis, Simonds and to some extent Hobbes have supported the development of human rights and whilst sceptics such as Bentham may tarnish such support there is and always will be a future for global human rights. Outline the control of the heart beat in terms of myogenic muscle contraction, the role of the pacemaker, nerves, the medulla of the brain, epinephrine (adrenaline)

Outline the control of the heart beat in terms of myogenic muscle contraction, the role of the pacemaker, nerves, the medulla of the brain, epinephrine (adrenaline) The human heart is a double circulatory system, which consists of the pulmonary circulation and the systemic circulation. In the pulmonary circulation, the heart pumps the deoxigenated blood from the heart through the pulmonary artery to the lungs and from there it pumps the oxigenated blood through the pulmonary vein back to the heart. In the systemic circulation, the oxigenated blood is pumped through the aorta to the body and back to the heart through the vena cava. To produce the necessary pressure to pump the blood through the body, the heart has to contract and squeeze the blood out of it. This is known as the cardiac cycle. The cardiac cycle has three phases: the atrial systole, the ventricular systole and the diastole. In the atrial systole the blood is squeezed from the contracting atria into the relaxing ventricles. In the ventricle systole the ventricles contract and pump the blood out of the heart whereas the atria relax and refill. In the diastole the whole heart is relaxed and it refills. The frequency of the cardiac cycle is called heart rate. A normal adult should have a heart rate of 70bpm when in rest. The heart has an own inherent rhythm, that means that the heart muscle, the cardiac muscle,
